Attorneys Geoff Hand and Megan Grove Present at the 10th Annual Vermont Development Conference

Attorneys Geoff Hand and Megan Grove are presenting at White & Burke’s 10th Annual Vermont Development Conference. This event allows opportunity to connect and network with industry leaders, fellow professionals and developers.

Megan will moderate a panel addressing the opportunities and challenges of redeveloping brownfields to build new housing in Vermont. Panelists will provide insight into their experiences navigating the legal and economic challenges associated with brownfields redevelopment, and how to tap into existing state resources.

Geoff will be speaking on a panel addressing the future land use regulation based on the passage of Act 181. This law significantly amended Act 250, Vermont’s statewide land use planning law, and will affect state, municipal and regional land use processes. Panelists will highlight changes in the law and the role and work of the newly created Land Use Review Board.

Attorney Geoff Hand to Present at 2024 State and Local Government Municipal Day

Attorney Geoff Hand will be presenting at the 2024 State and Local Government Municipal Day hosted by the Agency of Natural Resources, in cooperation with Vermont Emergency Management, The Natural Resources Board, the Agency of Transportation, and the Agency of Agriculture Food & Markets.  The conference will be held on November 1, 2024 and provides a day of workshops for Vermont’s local government officials.

Geoff will be speaking on a panel on the future of land use regulation in Vermont.  The workshop will provide an overview of the significant changes to Act 250 adopted this year in the legislature under Act 181 and how these changes affect state, municipal, and regional planning commission processes.  Topics covered will include the timeline for implementing Act 181 as well as the interim exemptions that provide an on ramp to the new “tiered” system of land use review.

The Agency of Commerce and Community Development representatives will discuss the incentive programs of the new Community Investment Board, and Municipal and Regional Planning Commission representatives will discuss their roles developing updated plans and to implement the new tiered system and designated areas.

Attorneys Geoff Hand and Megan Grove Present at 2024 Vermont Conservation Conference

Attorneys Geoff Hand and Megan Grove are presenting at the 2024 Vermont Conservation Conference held at the Vermont State University, Randolph campus. The conference is held for the conservation community across Vermont to meet and share resources to foster discussions regarding collaborative, strategic and informed conservation work and planning.

Geoff and Megan will present with Attorney Dave Gurtman, of Dinse, P.C., on the issue of private benefit for 501(c)(3) non-profit organizations that hold conservation easements. The panelists will provide an overview of the private benefit doctrine, discuss common scenarios where private benefit concerns arise, and explain when it is appropriate to seek experienced legal counsel to analyze the risk of private benefit.

Geoff Hand to present at Vermont Environmental Consortium’s Investigation and Remediation Conference

Partner Geoff Hand will be participating in a at the Vermont Environmental Consortium’s Investigation and Remediation Conference at Main Street Landing in Burlington on Tuesday, December 6.  The conference focusses on current permitting and remediation issues.

Geoff will be presenting with Trish Coppolino of the Vermont Department of Environmental Conservation (DEC) and Hannah Weiss of Atlas Environmental on a panel entitled, “PCB Regulation in Vermont in School Buildings and Commercial Buildings.” This panel will focus on PCB regulation and anticipated regulatory changes in Vermont, technical procedures for inventorying and sampling for PCBs in materials and indoor air and remediation options.  The panel will also address the DEC’s regulatory work regarding PCBs in non-school buildings and how it may affect redevelopment of properties constructed or renovated before 1980.

Geoff Hand to present at White + Burke Vermont Development Conference

Partner Geoff Hand will be participating in panel at the annual White + Burke Vermont Development Conference on Thursday, November 17 at the Hilton Waterfront Hotel in Burlington. The conference focusses on current economic trends, permitting issues, and economic growth.

Partners Drew Kervick and Geoff Hand to present at the annual White + Burke Vermont Development Conference

Partners Drew Kervick and Geoff Hand will be participating in panels at the sixth annual White + Burke Vermont Development Conference on Wednesday, November 6 at the Hilton Waterfront Hotel in Burlington. The conference addresses current economic trends, permitting issues, economic growth, and looking forward to the future.

Drew will share his expertise on Opportunity Zones in a top ten format, briefing the audience on updates to and best practices for the 2017 Tax Cuts and Job Acts program. Drew presented on Opportunity Zones at last year’s event, and has previously written about the program in this blog.

Geoff will participate in a panel addressing the implications of developing on a site with contaminated soils, sharing his expertise in CERCLA (superfund) liability, the scope of implicated costs in both investigation and cleanup, property damage, and personal injury claims. Richard Spiese of the Vermont Department of Environmental Conservation will also speak on the panel, as well as Tom Broido (ATC Group Services LLC) and Miles Waite (Waite-Hendel Environmental Management).

Goddard College Opens New Biomass Woodchip Boiler Heating System

Goddard College has opened a new woodchip boiler plant that will carry hot water underground to heat 22 buildings across campus, replacing oil-burning boilers. The new $2.5 million boiler provides 3 million Btu and displaces roughly 50,000 gallons of oil by using local advanced wood heating.

The wood chips used will come from within a 30-mile radius and are a forestry byproduct. SRH Law has proudly provided years of permitting work for this facility, including zoning, an Act 250 application, and work on a 2014 Vermont Supreme Court appeal.

This project was 14 years in the making. Goddard aims to become carbon neutral in fuels burned on campus and electricity usage by 2020. Vermont has a statewide goal to reach 35% of our thermal energy needs from wood by 2030 and 90% renewable energy by 2050.

He currently serves on the Vermont Businesses for Social Responsibility’s Public Policy Committee and is co-chair of the Vermont Bar Association’s Health Law Section. In 2015, Drew moved back to his hometown of Cornwall, where he lives in an old farmhouse with his wife and two (soon to be three) boys. Drew splits his work-week between the firm’s primary office in Burlington and his home office in Cornwall. Outside of work, Drew enjoys listening to Danish fiddle music, boiling sap, and indulging in pie of all varieties.

Project Development in Vermont: Putting Together the Permitting Puzzle

Geoff Hand, together with a panel of state experts, presented a CLE at the Vermont Attorney General’s office this week on Act 250, Vermont’s land use and development law.

Geoff’s presentation provided an overview of the land use permitting process in Vermont, described the key steps in preparing an Act 250 application, and provided an overview of Environmental Court procedures, and how to manage multiple consolidated appeals.

Other presenters covered the history of Act 250, the environmental criteria evaluated under Act 250, the process for initial review of applications at the District Commissions, and the process for appeals from the Environmental Court to the Vermont Supreme Court.

Geoff Hand and Drew Kervick Present at the 2017 Vermont Bar Association Winter Thaw

Last weekend SRH Law partner Geoff Hand and associate Drew Kervick presented at the 2017 Vermont Bar Association Conference, the YLD Winter Thaw, held in Montreal on January 13th and 14th.

Geoff presented as part of a panel of experts on Act 250, Vermont’s land use and development law. His presentation focused on key strategic decisions to be made by parties participating in the Act 250 process, including developers, municipalities, and individuals or adjoining landowners. He also described the relationship between Act 250 and other important permitting processes in Vermont, and offered comments on areas for potential amendments to the process going forward.

Drew presented with Commissioner Mike Pieciak from the Vermont Department of Financial Regulation on federal and state securities laws and how they impact small businesses trying to raise capital.  Much of Drew’s portion of the presentation involved a detailed overview of certain exemptions from federal securities registration requirements that may be useful to Vermont businesses.  The presentation also covered important state-based registration exemptions such as the Vermont Small Business Offering Exemption.
