SRH Law and ECHO Celebrate Art+Soul 2013

The firm celebrated the second annual Art+Soul event last Thursday. It was a great evening of art, music, and food, benefiting ECHO Lake Aquarium & Science Center. The artwork was truly inspiring. Photos from the event are posted on the SRH Law Facebook page.

Art+Soul 2013 features almost 200 pieces of art by more than 80 local artists, all inspired by ECHO’s mission, which is to educate and delight people about the ecology, culture, history, and opportunity for stewardship of the Lake Champlain Basin.

Vermont PSB Approves Three Projects for Standard-Offers

On May 16 the Vermont Public Service Board (PSB) announced the selection of three renewable energy projects as part of the SPEED Standard Offer program’s new Request for Proposal (RFP) process. The proposals were submitted after the PSB implemented programmatic changes to the Standard-Offer program in March (discussed in detail in a previous post).

The PSB authorized the SPEED Facilitator to enter into Standard Offer contracts with the three projects that proposed the lowest prices on a $/kWh basis: (1) Bennington Solar (2.0 MW, Ecos Energy, LLC); (2) Sudbury Solar (2.0 MW, Ecos Energy, LLC); and (3) Champlain Valley Solar Farm (2.2 MW, Champlain Valley Solar Farm, LLC).  The PSB additionally authorized the Facilitator to place three projects in the 4.5 MW project reserve authorized under the new program; projects slated for the reserve are: (1) Otter Valley Solar Farm; (2) Whiting Solar Center; and (3) Mountain View Solar Center.

The top three lowest price proposals were actually Bennington Solar, Apple Hill Solar, and Sudbury Solar, with Champlain Valley Solar coming in fourth.  However, Apple Hill was disqualified after the PSB determined that, because the proposed Bennington Solar and Apple Hill Solar projects “are located on the same parcel of land and have similar interconnection points,” they “constitute[d] a single 4.0 MW plant for the purposes of Section 8002(14)” (defining what constitutes a “plant” under the statute).  The statute only allows projects to be up to 2.2 MW.  Because the proposals were separately submitted, the PSB determined that the higher priced and second-in-line Apple Hill project was the ineligible one.  On May 21st Ecos Energy filed with the PSB a request for reconsideration of its decision to reject Apple Hill’s proposal.

Relative to the provider block, the PSB authorized the Facilitator to enter into a contract with Green Mountain Power to develop a 150 kW solar project in Rutland.

Absent an extension, authorized Standard-Offer contracts must be executed by June 26, 2013.

Vermont Takes On Patent Trolls in New Legislation

Earlier this week, the Vermont legislature passed a bill, entitled H.299, that attempts to place barriers in front of entities looking to extort money from businesses based on bad faith assertions of patent infringement (e.g., some patent trolls).  Justin McCabe explains the immediate effects and benefits of this bill on the Green Mountain IP blog.

Eileen Elliott in the news: Vermont Health Exchange and Small Businesses

SRH Law attorney Eileen Elliott published an article, Navigating the health exchange for small businesses, in the Creative Corner in the Burlington Free Press. In her article, Eileen describes the upcoming health exchange, Vermont Health Connect, and how the changes will affect small businesses.

Eileen also spoke with the Associated Press about the health care changes in Vermont. The article, Businesses may get sticker shock on health care, describes the national implications of the Affordable Care Act on small businesses.

The complexity of the U.S. patent system presents challenges for all innovators, and with the advent of the America Invents Act last year, the rules governing patents have only become more complex. Entrepreneurs and researchers need to have an understanding of the basics of patent law and need to pay special attention to their pre-application filing activities. This presentation will cover the nuts and bolts of obtaining a patent and the potential consequences to certain activities that were previously thought to be “safe” pre-patent filing activities.

Justin McCabe is an intellectual property attorney for the firm SRH Law with a background in chemical engineering. He currently lives in Montpelier with his wife and two kids and a dog that’s not very bright, but is friendly enough.

Eileen Elliott interviewed on Inc.com

Adam Bluestein from Inc.com interviewed SRH Law partner Eileen Elliott on April 2nd about the Affordable Care Act.

The article, “What Will Obamacare Do To Your Insurance Premiums,” focused on how Vermont’s proposed rates for the insurance exchange will affect small businesses and theorized what this will mean for other states.

Of course, Vermont isn’t exactly like the rest of America (Bernie Sanders, anyone?). It has a history of progressive healthcare policy. Community rating, which prohibits insurers from varying rates based on health status, went into the effect in the state in the mid-90s, and insurers already have been required to meet most of the ACA’s other requirements. Inc.com.

The U.S. patent system is undergoing substantial change on March 16 when the new laws redefining ‘prior art’ take effect, lowering the probability that the developer of an invention will be able to patent it. This has particular implications for Vermont’s patent ratings, since the ranking is determined on a per capita basis.  SRH Law’ Justin McCabe, an attorney specializing in trademark and patent law, lays out the implications of the new definitions, the benefits of filing a patent application before and after the March 16 deadline, and the implications of the USPTO’s new guidelines for Vermont innovators.
