Eileen Elliott to give webcast on HIPAA compliance

The changes to the HIPAA privacy and security rules that went into effect in September 2013 are still unfamiliar to a number of entities required to comply with HIPAA because they provide services that involve the use or disclosure of protected health information. All entities that deal with health information or with healthcare organizations need to assess their compliance status against these new rules and identify high risk areas for preventive action. Many times, these high risk areas involve social media and new technology. This webcast will discuss:

  • Key provisions of the new rules
  • Implications of the revised definition of breach
  • What the new rule means for business associates and the organizations they serve
  • The structure of enforcement and fines
  •  How technology can help and hurt HIPAA compliance

SRH Law is seeking a motivated attorney with 3-5 years of experience primarily in a transactional practice to join our legal team as an associate attorney in our Burlington, Vermont-based practice.

The attorney will focus on supporting the firm’s municipal and affordable housing practice areas. The firm is seeking candidates with experience in commercial real estate transactions, land use law, private and municipal project finance, municipal law, and/or landlord/tenant issues.

Candidates must be graduates of an accredited law school, hold a JD degree, and be admitted to practice before the Vermont Bar.  Experience in a law firm or corporate law department, including experience in one or more of the firm’s core practice areas, is preferred.

Geoff Hand appears before Vermont Supreme Court for Kingdom Community Wind Project

geoffrey-handSRH Law Partner Geoffrey Hand appeared yesterday before the Vermont Supreme Court arguing on behalf of Green Mountain Power.  The case involves a legal challenge to the stormwater permits issued to Green Mountain Power for the Kingdom Community Wind Project located in Lowell, Vermont.

The Burlington Free Press reported on Thursday’s Supreme Court argument.

Eileen Elliott discusses HIPAA compliance for small health care providers

SRH Law partners to present and moderate at the 2013 Renewable Energy Vermont Conference

Brian Dunkiel will be speaking about marketing renewables in compliance with the law at the 2013 Renewable Energy Conference and Expo . Dunkiel will present during the “Making Projects Happen & Seeing Results” workshop session from 2:15 to 3:30 p.m. on the first day of the event, October 28.

In addition, Andrew Raubvogel and Geoffrey Hand will be moderating workshop sessions at the REV conference on the second day, Tuesday, October 29. Raubvogel will moderate the net-metering workshop,“Where to from Here?” from 11:05 a.m. to 12:05 p.m. Hand will moderate the “Permitting Renewables in Vermont: Past Success Stories and Future Recommendations from the Siting Commission” from 2:35 to 3:35 p.m.

Justin McCabe to present on copyright issues at 2013 Vermont Arts Summit

JMSRH Law intellectual property attorney Justin McCabe will present at the 2013 Vermont Arts Summit on Saturday, October 26 at the Vermont State House in Montpelier.

The presentation, Copyright Basics in the Digital Age, begins at 11 a.m. and  covers the nature, scope and duration of copyright protection; how to obtain and maintain copyright protection; a discussion of the different kinds of copyrighted works; monetization; and an overview of the litigation process, including summaries on damages and defenses.  Also, the presentation discusses the development of copyright in the age of the Internet and the way that the fundamental concepts are adapting to new technologies, while addressing the statutory protections given to websites under the Digital Millennium Copyright Act, issues of cybersquatting, social media copyright policies, and the special concerns caused by new forms of publishing.

Following this presentation, attendees should have a basic understanding of copyright law and be able to identify potential issues as copyright work creators. In the afternoon, McCabe will also take part in small group clinics where people can bring their IP questions.

In August, the FDA announced the new standards that are aimed to protect those with Celiac disease. The article explains the details of the new rule and what food companies need to know to comply with the regulations and avoid the risk of regulatory enforcement action.

The attorneys provide suggestions for avoiding potentially deceptive advertising, including avoiding general claims, such as simply claiming a product is “eco-friendly.” The tips also highlight the importance of a “reasonable consumer” in making claims.

The article also explains how the revised FTC Green Guides are a key resource for environmental marketing.
